have I always understood something about the marriage license that most people never question?

Ask Yourself:

Why did you believe you had to ask the state — and pay a fee — for permission to marry?

Did you ever stop to research what that license actually represents?

A license is a contract with the state.

It introduces a third party into the union — a corporate interest tied to what the state defines as outcomes of that marriage, including matters involving children.

This is often cited as the point where state jurisdiction becomes involved in family matters.

I’ve heard this explained directly by social workers themselves.

Another Way Exists

Marriage can also be entered into through a covenant, witnessed by two people, and recognized as lawful.

And that brings us to the distinction most people were never taught:

Legal = what you agree to

Lawful = what you have a right to
